Consent Issues: fire rating between a house and freestanding garage

Advice please -
We are struggling to obtain a Consent to build a freestanding garage behind an existing house.  The two buildings apparently have to be 2 metres apart, or a notional boundary comes in to play and one of the buildings will have to be fire rated.
I am questioning why this is required, since a garage attached to a house (or, indeed, underneath a house) requires no such rating.
Has anyone else experienced this situation?
